Jones Kopp Litigation is pleased to report a recent success at the Licence Appeal Tribunal.
In Ramnathsingh v. Echelon Insurance Company, Adjudicator Melanie Malach found that the applicant was barred from proceeding with her application due to her repeated failure to attend insurer’s examinations under section 44 of the Statutory Accident Benefits Schedule (SABS).
This decision reinforces the importance of compliance with insurer examinations and confirms the Tribunal’s continued application of section 55(1)(2) of the Schedule in circumstances where a claimant fails to cooperate with required assessments.
